Terms & Conditions

1. About Wholeheartedly and these terms

Wholeheartedly is a privately owned, unincorporated small South African business based in Great Brak River, Western Cape. It is not company-registered and is not VAT-registered. These terms cover purchases through the Wholeheartedly website, including the Wholeheartedly and Dazzling Daisies collections. Collection and trading names do not identify separate incorporated companies.

The legal seller is Wholeheartedly. Country of domicile: South Africa. Website: wholeheartedly.co.za. Customer service email, telephone, business hours and Information all available on the Contact Us Page.

2. Scope and consumer protection

These terms apply to use of this website and purchases from the seller. Read them alongside the product description and the delivery, returns and privacy information shown before placing an order. Nothing in these terms excludes, restricts or overrides rights under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), the Protection of Personal Information Act 4 of 2013 (POPIA), or other applicable law. Mandatory law prevails if a term conflicts with it. Product-specific conditions must be disclosed before purchase and cannot remove statutory rights.

3. Products and collections

The Wholeheartedly and Dazzling Daisies collections include the products described in their individual listings. Please check each listing for materials, dimensions, quantities, colour, care instructions and any customisation or lead time. Images illustrate the product; screen settings may affect colour appearance. Handmade variation must be disclosed where relevant and does not excuse supplying defective goods or goods materially different from their description. No substitute product will be supplied without your agreement.

4. Prices and orders

Prices and transactions are in South African rand (ZAR). Wholeheartedly is not VAT-registered and does not charge VAT. The total payable, including applicable delivery charges and any other compulsory charges, must be disclosed before you confirm payment. No additional charge will be imposed without your agreement.

Review your items, delivery details and total before submitting an order. An automated receipt acknowledges submission; acceptance occurs when order-confirmation processed and checkout has been completed. Payment alone does not excuse a failure to supply. If an item is unavailable, we will notify you promptly and refund amounts paid as required by law; you may choose an alternative only by agreement. We will not unilaterally increase an accepted order’s price. Obvious pricing errors will be addressed fairly and subject to applicable law.

5. PayFast payments

Payments made using the PayFast option are processed by PayFast, subject to the payment methods available at checkout and PayFast’s applicable payment-service terms. Wholeheartedly remains responsible for the sale, fulfilment, customer service and lawful refunds. PayFast is the payment processor and is not the seller of our products. Payment must be authorised and confirmed; an unpaid or failed payment does not establish successful payment.

Do not send card numbers, card security codes, passwords or one-time codes to us by email, message or contact form. Refund requests for purchases should be directed to Wholeheartedly. Where supported, authorised refunds will be processed through the original payment method, subject to statutory requirements and processing times. Payment-provider delays do not remove your rights.

See PayFast’s terms and PayFast’s privacy notice for its services. These do not replace Wholeheartedly’s obligations to customers.

6. Shipping, delivery and collection

Shipping is charged at a flat rate of R130.00 for delivery within South Africa.

Pudo locker shipping can be arranged separately for remote areas. Please contact us to discuss the available arrangements and confirm any applicable costs before placing your order.

Standard courier delivery takes an estimated 5–8 business days. We do not offer international shipping. Tracking details will be sent to you on completion of your order.

Provide an accurate delivery address and contact details. Contact us promptly if they need correction; changes depend on the order’s progress. Any additional delivery charge must be lawful and disclosed. We will communicate material delays and agree a revised arrangement where appropriate. Delivery risk and responsibility remain governed by applicable consumer law; handing goods to a courier does not automatically transfer all risk to you. You are not required to waive rights by signing for a parcel.

For transactions covered by ECTA section 46, the order must be executed within 30 days after receipt unless another period is agreed. If we fail to perform within that period, you may cancel with seven days’ written notice. If goods are unavailable, we will notify you immediately and refund payment within 30 days of that notification. Inspect deliveries reasonably promptly and report missing, incorrect or damaged items, but an administrative reporting request cannot shorten statutory rights.

7. Returns, cancellations and refunds

Wholeheartedly Gifts — The Home of Dazzling Daisies Ribbon

Every order is packed with care and attention to detail. We take pride in offering beautiful, quality ribbons and gifts, and want every customer to have a positive shopping experience. Please read this policy before placing your order.

7.1 Returns and exchanges

Please select your products carefully before purchasing. For eligible online purchases, you may cancel within seven days of receiving the goods in accordance with applicable South African consumer legislation. For change-of-mind returns, we request that products be unused, uncut, undamaged and in their original packaging wherever possible. These preferences do not override statutory rights. You are responsible for the direct cost of returning goods for a qualifying change-of-mind return.

Where ECTA section 44 applies, cancellation is without reason or penalty; the only charge permitted under that provision is the direct cost of returning the goods, and payment must be refunded within 30 days of cancellation. [CONFIRM any voluntary return or exchange period beyond statutory rights and the exchange procedure.]

7.2 Ribbons and cut products

Please check the ribbon design, width, colour and quantity before ordering. Ribbons used, altered or cut by the customer may not qualify for a change-of-mind return, subject to applicable consumer rights. Ribbons specially manufactured, personalised or cut to your individual specifications may be excluded from change-of-mind returns only where a statutory exception genuinely applies. These exceptions do not remove rights concerning defective, incorrect or misdescribed goods.

7.3 Damaged, defective or incorrect items

Please contact us as soon as possible, preferably within 48 hours of delivery, with your order number, a description of the problem and clear photographs where available. The 48-hour request helps us investigate promptly; it is not a deadline that limits your statutory rights. Photographs assist assessment but are not an absolute condition of a lawful remedy. Each case will be assessed fairly, and eligible returns, replacements and refunds handled in accordance with applicable South African consumer protection legislation.

Where CPA sections 55 and 56 apply, goods that fail the statutory quality standards may be returned within six months of delivery, without penalty and at the supplier’s risk and expense. You may direct the supplier to repair, replace or refund, subject to the Act. If a repair fails or another defect appears within three months of repair, the applicable replacement or refund remedy remains available. Other statutory return and delivery rights remain available.

7.4 Colour and print variations

Screen colours may differ slightly from actual printed ribbon. Small manufacturing variations in colour, fabric texture or print positioning may occur and are not necessarily defects. This does not excuse a material departure from the product description, agreed specification, sample or statutory quality requirements.

7.5 Refunds

Once a return has been received and assessed, we will notify you of the outcome. Approved refunds will be processed through the original payment method wherever possible and within the timeframes required by applicable South African legislation. Assessment or payment-provider processing must not extend statutory refund deadlines, including the applicable ECTA cooling-off deadline described above.

7.6 Courier and return costs

For qualifying change-of-mind returns, customers pay the direct return costs. Where we supply an incorrect or defective product, Wholeheartedly Gifts will arrange an appropriate solution and bear return costs as required by law. Where CPA section 56 applies, the return is at the supplier’s risk and expense without penalty. We recommend a reliable courier with tracking; this recommendation does not shift a supplier’s statutory risk to you.

7.7 How to request a return

Please contact us before returning goods so we can assist with the procedure and correct return address. Include your order number in correspondence, or other reasonable proof of purchase if it is unavailable. Contacting us first is an administrative request and does not remove statutory rights.

Email: wholeheartedly777@gmail.com  Business: Wholeheartedly Gifts — The Home of Dazzling Daisies Ribbon. Returns address: 8 Lang Straat, Grootbrak Rivier, 6525. Do not send a parcel to an unconfirmed address.

7.8 Our commitment to you

We value our customers and will do our best to resolve concerns with kindness, fairness and care. Nothing in this policy excludes or limits any rights under applicable South African law. No blanket “no refunds” rule applies.

Chosen with heart, tied with love.

8. Privacy and POPIA

Wholeheartedly must process personal information lawfully under POPIA. The intended purposes include responding to enquiries, processing orders and payments, arranging delivery, preventing fraud and meeting legal recordkeeping obligations. Only information reasonably necessary for these purposes should be collected. Service providers such as Shopify, PayFast and delivery providers may receive information necessary for their roles, subject to appropriate safeguards.

Marketing must comply with applicable consent and direct-marketing rules and provide a way to opt out. You may request access to your personal information, correction or deletion where applicable, object to qualifying processing, withdraw consent where processing relies on consent, and complain to the Information Regulator of South Africa. These rights are subject to lawful exceptions, including required record retention.

9. Security

Appropriate technical and organisational safeguards must be maintained for personal information and payment transmission. Use the legitimate website and checkout, protect your account credentials and report suspected fraud. No online system can guarantee absolute security. We do not ask customers to disclose payment credentials in ordinary correspondence.

10. Intellectual property and website use

Website text, photographs, artwork, logos and designs belong to Wholeheartedly or their respective rights holders, where applicable. Browsing and buying do not transfer intellectual property rights. Do not reproduce protected content for commercial use without permission, except as permitted by law. Do not misuse the website, interfere with its operation, upload malicious material or attempt unauthorised access. You remain free to exercise lawful consumer rights and share truthful reviews.

11. Responsibility and matters beyond our control

We will take reasonable care in operating the website and fulfilling orders. If an event beyond reasonable control affects performance, we will notify affected customers and explain available options. Such events do not extinguish statutory cancellation, refund or delivery rights. Nothing excludes liability that cannot lawfully be excluded, including applicable liability for defective goods, fraud or gross negligence. No broad waiver of customer rights is required.

12. Governing law, complaints and changes

South African law governs these terms, subject to any mandatory protections that apply. Please contact us first with your order reference and concern so we can attempt a fair resolution. This does not prevent you from using a competent consumer-protection body, regulator or court, including the National Consumer Commission, the Consumer Goods and Services Ombud where applicable, or the Information Regulator for privacy matters.

Changes to these terms must be dated and communicated appropriately. The terms disclosed when an order is concluded govern that order unless a lawful change is agreed. Later changes cannot retrospectively remove accrued rights. An invalid provision does not affect the remaining lawful provisions.
